1. Introduction

Welcome to the TheraVista Health, Inc. (“TheraVista,” “we,” “our,” or “us”) mobile application (the “App”). By downloading or using this App, you agree to these Terms and Conditions. Please read them carefully before using the App.

2. App Description

The App provides exercise guidance and interactive tools to support physical therapy exercises through text and video instructions. It uses your smartphone’s camera to detect movement and turn your physical motions into gameplay onscreen.
No video or image data is saved, transmitted, or stored. The App processes motion data in real time solely to support the game experience.

3. No Data Storage or Health Information

The App does not:

• Store or transmit any personally identifiable information (PII) or protected health information (PHI).

• Record or save videos, images, or health performance data.
  All processing occurs locally on your device and is temporary.

4. Safe Use Disclaimer

Use the App responsibly and only in a safe environment.
You are responsible for ensuring you have a stable surface nearby—such as a chair, countertop, or railing—to maintain balance and prevent falls.
If you feel dizzy, lightheaded, or unwell while using the App, stop immediately and wait until you feel stable before resuming.

If you experience persistent pain, dizziness, or other medical problems, contact your doctor or a licensed physical therapist before continuing. This App is intended for educational and motivational purposes and is not a substitute for professional medical evaluation, diagnosis, or treatment.

5. No Medical Advice

This App does not provide medical advice. Always consult your healthcare provider with any questions you may have regarding your health condition or treatment plan. Reliance on information provided by the App is solely at your own risk.

6. License to Use

TheraVista grants you a limited, non-exclusive, non-transferable, and revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

7. Ownership and Intellectual Property

All content, code, and materials within the App are owned or licensed by TheraVista Health, Inc. and are protected by applicable intellectual property laws.
You may not copy, modify, reverse engineer, distribute, or commercially exploit any part of the App.

8. Termination of Service

TheraVista reserves the right to modify, suspend, or discontinue the App at any time without notice and without liability.

9. Disclaimers and Limitation of Liability

The App is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the fullest extent permitted by law, TheraVista Health, Inc. and its officers, employees, and affiliates shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from or related to the use or inability to use the App.

10. Indemnification

You agree to indemnify and hold harmless TheraVista Health, Inc. and its officers, directors, employees, and affiliates from any claims, losses, or damages arising from your misuse of the App or violation of these Terms.

11. Governing Law and Jurisdiction

These Terms are governed by and construed under the laws of the State of Tennessee, United States of America, without regard to its conflict of law principles.
Any dispute arising from or relating to these Terms or the App shall be brought exclusively in the state or federal courts located in Nashville, Tennessee, USA, and all parties consent to their jurisdiction and venue.

12. Updates to These Terms

We may update these Terms from time to time. Continued use of the App after changes are made constitutes acceptance of the updated Terms.
